Sexual harassment in the workplace creates serious legal and reputational risks. When termination is out of consideration, disciplined counseling serves as a structured response. Our sessions focus on behavior correction through individualized guidance and documented accountability.

Our Disciplinary Counseling Services

We run a systematic program to assist employees who have been involved in a case of abuse and require corrective action. We deliver:

  • Individual Post-Incident Counseling

One-on-one sessions tailored to the specific misconduct incident.

  • State-Specific Legal and Policy Training

Guidance based on Hawaii statutes, federal law, and your company’s internal rules.

  • Pre- and Post-Assessment Testing

Evaluations measure knowledge gaps, ensuring the employee understands the violation and expected conduct.

  • Comprehensive Documentation

Written summaries, test results, and professional recommendations become part of the employee’s personnel record.

  • Ongoing Monitoring and Reporting

Monthly check-ins with HR and senior management to track progress and reinforce compliance.

All sessions are confidential, professional, and focused on preventing repeat violations.

Compliance Challenges in Hawaii

Hawaii employers have to deal with and consider ever-changing state laws and enforceable court decisions while taking into consideration harassment cases in their work environment:

Nondisclosure Agreement Restrictions

Since July 2022, NDAs silencing employees from reporting sexual harassment or assault in the workplace have been prohibited under the laws of the State of Hawaii. Besides, it prohibits employers from waiving employees’ right to discuss incidents of sexual misconduct with outside parties.

Timely Reporting Requirements

A complaint must be made by an employee with the Hawaii Civil Rights Commission within 180 days after the last act of harassment. A charge outside the window could restrict the employer from conducting an investigation or otherwise resolving the matter.

Local Enforcement Trends

Hawaii courts and administrative bodies now generally want to know how the disciplinary measures have been carried out. Proper documentation, along with counseling before the fact, does mitigate against the chance of being sued or subject to administrative penalties.
