Compliance Challenges in Hawaii

Hawaii employers have to deal with and consider ever-changing state laws and enforceable court decisions while taking into consideration harassment cases in their work environment:

Nondisclosure Agreement Restrictions

Since July 2022, NDAs silencing employees from reporting sexual harassment or assault in the workplace have been prohibited under the laws of the State of Hawaii. Besides, it prohibits employers from waiving employees’ right to discuss incidents of sexual misconduct with outside parties.

Timely Reporting Requirements

A complaint must be made by an employee with the Hawaii Civil Rights Commission within 180 days after the last act of harassment. A charge outside the window could restrict the employer from conducting an investigation or otherwise resolving the matter.

Local Enforcement Trends

Hawaii courts and administrative bodies now generally want to know how the disciplinary measures have been carried out. Proper documentation, along with counseling before the fact, does mitigate against the chance of being sued or subject to administrative penalties.

HPD Whistleblower Alleges Discrimination and harassment:

A female officer has sued the Honolulu Police Department HQ for discrimination based on gender and sexual harassment. The complaint cites inappropriate conduct at the training academy and allegedly refers to a “sex party” at a beach house in Waimanalo, Hawaii. The officer’s concerns were presumably ignored. These instances shed light on the systemic nature of the problem within the department.
